Emily Snyder, spokesperson for the Massachusetts Office of the Attorney General and Carol Bosco Baumann for the Berkshire Museum convey a shared goal: “We are working together to resolve this matter, recognizing our shared responsibility for the collection of the Berkshire Museum and to the community the museum serves. We are committed to helping this museum secure its future.”

Joint Status Report of the Attorney General and Trustees of the Berkshire

The Substituted Plaintiff-Appellant Attorney General Maura Healey (“AGO”) and Defendant-Appellee Trustees of the Berkshire Museum (the “Museum”) submit this joint status report.

The AGO has now concluded its investigation into the decision by the Museum to sell 40 works from its collection. The additional time granted by this Court for the investigation permitted the AGO, with the Museum’s cooperation, to undertake additional review of inter alia over 1500 documents and interview further key Museum employees and board members. The AGO believes that the 40 works at issue are subject to restrictions, which the Museum does not believe exist. The AGO and the Museum have agreed to resolve these differences and will file a petition for judicial relief pursuant to the principles of equitable instruction, deviation and/or cy pres with the Single Justice of the Supreme Judicial Court on February 9, 2018 or shortly thereafter. The AGO will support the relief requested by the petition. In addition, the Museum will not sell any of the 40 works until the SJC acts on the petition or until the Berkshire County Superior Court enters final judgment regarding the AGO’s complaint in the matter captioned Rockwell et al. v. Trustees of the Berkshire Museum, No. 17-253 (allowing, if the Museum should prevail, for 7 calendar days post-judgment for the AGO to seek further relief pending appeal), should such proceedings again become necessary. The Museum and the AGO intend to file a motion in the trial court requesting that proceedings there be held in abeyance while the aforementioned petition is pending. As a result of these commitments by the Museum, the AGO does not seek any further injunctive relief or stay of Superior Court proceedings at this time.

On my way home from visiting my daughter Liv who lives in Brooklyn, I stopped at several locations along the Connecticut coast where Snowy Owls have recently been sighted. Although no owls materialized, it was super interesting to learn about the diverse range of habitats hosting Snowies during this fantastic Snowy Owl irruption of 2017-2018. Liv and I spent Saturday morning exploring Jamaica Bay wildlife refuge and other habitats along the Brooklyn coastline where Snowies are also spending the winter. Photos to come when I have time to sort through but in the meantime, this funny little squirrel followed me about the Connecticut Audubon Refuge, coming quite close and seemingly wanting to play hide and seek. I played along for a bit and wished I had a peanut in my pocket 🙂

Choices

After sneaking in a little bit of work yesterday, I stopped by Sonny’s Mobile in Beverly to grab some gas and beer for the big game (sigh).

The number of choices was almost overwhelming, but those cans sure are pretty!

One season ends, another begins . . .

Great game last night, but not the ending we had hoped for! Congratulations Eagles!

One season ends and another begins, the Red Sox Equipment truck leaves for Fenway South today, pitchers and catchers report in 10 days and Red Sox open in Ft Myer February 22nd.

We are still the home of champions, seven titles in four sports in the last 10 years, so nothing to be down about!

My what big feet you have Hedwig! A Snowy Owl’s feet are covered in feathers, providing insulation against Arctic temperatures–just like a pair of warm fluffy slippers.

Hedwig left her perch and walked over to a patch of snow, which she proceeded to eat. She also washes her face and feet in snow patches.

Job Responsibilities

  • Responsible for ensuring the store is recovered and ready for business every day
  • Maintain record keeping accurately
  • Ensure that open/close procedures are followed
  • Ensure that all daily inventory management tasks are completed including but not limited to; stocking, zero outs, rain checks, special orders, cycle counting, etc.
  • Oversee staff in performing all store functions including: retail sales duties, cashiering, stocking, assembly, display and promotion of products, demonstrating good and safe work habits, and promoting positive attitude towards customers
  • Resolve customer complaints in a timely and satisfactory manner
  • Make sure that the sales floor is clear, organized and properly signed, and that the receiving floor is clear of pallets and trash
  • Responsible for training all associates on store policies and procedures
  • Delegate daily workload among associates
  • Enforces safety policies and procedures; is a safety role model
  • Displays ability to work flexible hours, and adjusts to seasonal requirements, schedule changes, including weekends and holidays, as dictated by business needs

 

Position Qualifications

  • High School diploma, some college preferred.  Possess a knowledge of hardware related products along with a willingness to learn
  • Minimum of 1-3 years retail management experience
  • Strong leadership and analytical skills
  • Excellent verbal and written communication skills with the ability to communicate clearly and effectively in all situations
  • Strong problem-solving and organizational skills
  • Ability to lead and develop others
  • Ability to handle multiple projects and tasks with a high attention to detail with the ability to prioritize
  • Knowledge of retail computer systems, MS Word and Excel a plus.
  • Ability and willingness to work flexible hours including evenings, weekends and holidays to meet the needs of the business
